    I was looking for something to buy and i came across this on the despair.inc™ official website
    they say they own the copyright to the emoticon :-(
    is this even possible and is it true?

    Unless you used it in the state of Texas, I think you'll be OK, Monetdell. They have yet to apply for a national application, so it should only be registered trademark in the state of Texas, where they are located. Also, they have not trademarked any of the following:

    However, I do think that it is possible that they could own the smiley, just as easily as thye could own any other word or phrase or combination of characters that happen to look like something. I'm going to try to talk a local business into copyrighting some thing like "leet" or "noob" or "-_-"

    i think it cost them billions of dollars just to buy the copyright for 2 symbols.
